These Terms govern your use of localmediaempire.com and the Local Media Empire software and materials (together, the “Product”), supplied by Nicely Media LLC. By buying or using the Product, you agree to these Terms.
Your licence
On purchase, you receive a personal, non-exclusive, non-transferable licence to use the Product for your own business or for clients you serve, in line with the plan you bought. You may not resell, sublicense, rent, share or redistribute the Product itself, or make your login available to others.
Your account
You are responsible for keeping your login details secure and for everything that happens under your account. Tell us promptly if you believe your account has been accessed without your permission.
Acceptable use
You agree not to use the Product to:
- Send unsolicited bulk email, or email anyone who has not agreed to hear from you.
- Publish content that is unlawful, defamatory, deceptive, infringing, or that you have no right to publish.
- Attempt to reverse-engineer, copy, resell or circumvent the software or its limits.
- Interfere with the service, or with anyone else’s use of it.
We may suspend or end access for serious or repeated breaches of this section.
Your content
Content you create, import or publish using the Product remains yours. You are responsible for it, for having the rights to use it, and for making sure it complies with the laws that apply to you — including publishing, advertising, privacy and anti-spam laws.
AI-generated content
The Product can generate content automatically. Generated output may contain errors or inaccuracies. You are responsible for reviewing anything you publish. We make no warranty that generated content is accurate, original, or suitable for any particular purpose.
Our intellectual property
The Product, this website, and all text, graphics, video and structure within them are protected by copyright and other laws and remain the property of Nicely Media LLC and its licensors. Nothing in these Terms transfers that ownership to you.
Payment
The Product is sold for a one-time payment at the price shown at checkout. JVZoo acts as the retailer for the transaction and their terms also apply to your purchase. Prices and promotional offers may change at any time; the price you paid is the price that applies to your purchase.
Refunds
Purchases are covered by our 30-day money-back guarantee, set out in full in our Refund Policy.
No guarantee of results
We make no promise of income, earnings or results. Please read our Disclaimer, which forms part of these Terms.
Availability
We aim to keep the service available and reliable, but we do not guarantee uninterrupted access. Maintenance, updates, and factors outside our control can all cause downtime.
Limitation of liability
To the fullest extent permitted by law, the Product is provided “as is” without warranties of any kind, and Nicely Media LLC is not liable for indirect, incidental, special or consequential losses, or for lost profits, revenue or data. Where liability cannot be excluded, it is limited to the amount you paid for the Product.
Nothing in these Terms limits any right you have that cannot be limited under the law that applies to you.
Third-party services
The Product may connect to third-party services such as email senders and integrations. Those services are governed by their own terms, and we are not responsible for them.
Termination
You may stop using the Product at any time. We may suspend or end your licence if you materially breach these Terms.
Changes to these Terms
We may update these Terms. Continuing to use the Product after an update means you accept the revised Terms. The “last updated” date shows when they last changed.
